Dreaming of an In-Law Suite? What to Know About Massachusetts’ ADU Laws

Are you dreaming of adding an in-law suite or backyard bungalow to your home? Whether it’s to provide a comfortable space for aging parents or a welcoming "boomerang" spot for grown children, you are not alone. The good news is that Massachusetts’ new Accessory Dwelling Unit (ADU) laws are making it significantly easier for families to create these essential spaces.

However, while the law is on your side, not every property is a "slam dunk" for an addition. Before you invest in a home with the intent to build, there are several strategic factors you must evaluate to ensure your vision can become a reality.

After living the multi-generational lifestyle for over a decade, I’ve learned that the right house makes all the difference. If you are exploring the possibility of an ADU or in-law suite, here are the five critical checks you need to perform:

  1. Zoning and Local Rules: While ADUs are now allowed statewide, individual towns still maintain their own regulations regarding setbacks, lot coverage, and specific permitting processes.
  2. Space and Layout Constraints: Under the new guidelines, you typically have room to build up to 900 square feet (or 50% of the main home’s size, whichever is smaller). Does your lot or existing structure accommodate this?
  3. Utility Capacity: Can your existing septic, sewer, and electrical systems handle the load of an additional kitchen, bathroom, and more residents? Upgrading these can be a significant hidden cost.
  4. Access and Privacy: A successful multi-generational home balances connection with independence. Look for properties that already have - or can easily accommodate - a separate entrance.
  5. Budget and Timeline: Beyond construction costs, you must account for design work and permit fees. Planning for both the financial investment and the construction timeline is essential for a stress-free transition.
